3. Copyright Act, 1957
It protects the original works of creators, including videos and music. Unauthorized use of copyrighted material on YouTube can lead to legal action. Influencers must ensure they have permission to use copyrighted content.
4. Consumer Protection Act, 2019 (CPA)
Influencers promoting brands or products may be held accountable for misleading advertisements under this act. Penalties are imposed on influencers for misleading endorsements or false claims.
5. Advertising Standards Council of India (ASCI) Guidelines for Influencers
Influencers must disclose paid promotions and partnerships on platforms like YouTube and all social media channels they are using. Sponsored content must be clearly marked to avoid misleading consumers.
6. The Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954
It prohibits influencers from endorsing drugs and treatments that make false claims about health benefits.
7. Indian Penal Code (IPC), 1860
Section 499 and 500: Defamation laws apply to content shared on YouTube. If a video harms the reputation of a person or entity, legal action can be taken.
Section 505: Addresses content that may incite hatred, violence, or disrupt public peace.
8. Juvenile Justice (Care and Protection of Children) Act, 2015
It ensures that content featuring children; adheres to child protection norms and guidelines. Special care must be taken by influencers working with or featuring minors in their content.
9. Income Tax Act, 1961
Influencers earning revenue through YouTube (ad revenue, brand deals) are subject to income tax under this act. The tax liability includes income earned from both national and international sources.
10. Foreign Exchange Management Act (FEMA), 1999
Influencers receiving payments from international sponsors or platforms like YouTube must ensure compliance with foreign exchange regulations under FEMA and other regulations being implemented by government of india.
11. Telecom Commercial Communications Customer Preference Regulations, 2018 (TRAI)
Influencers using digital platforms for promotions; must avoid sending unauthorized commercial communications without proper disclosures, especially in the case of email marketing or other communication channels tied to their YouTube presence.

12. Press Council of India Act, 1978 (If Relevant for News-Related Content)
